Our Terms Of Service
All accounts on Dot Com Presence.com servers are subject to these terms of service. We reserve the right to cancel without notice any account that violates our terms of service, with Dot Com Presence.com as the sole arbiter in deciding what constitutes violation.By placing an order, you acknowledge that you have read, understand, and agree to fully abide by our terms of service listed below. 1. Server Use Your account is for your use only, and as the primary user, you agree to take responsibility for all usage of the account. Maximum Hard Disk Space and Bandwidth. You shall be allotted an amount of storage space on Dot Com Presence.com's hard drive according to the hosting plan you sign up for at the time of order, which may be used to store your Web Pages, ordering information and databases, and user communications. All services provided by Dot Com Presence.com may be used for lawful purposes only. Any violations of laws that apply to Dot Com Presence.com, or any jurisdiction that applies to you or your site is strictly prohibited. This includes but is not limited to copyrighted material, intellectual property and threatening material. You are NOT allowed to upload any type of audio/video files (.mp3,.avi etc) that belong to other artists UNLESS you have a prior permission of its reproduction on your website. Any website found violating United States or International Copyright Laws will be terminated instantly. No refunds will be issued in this case. Sites that promote illegal activity or present content that is damaging to Dot Com Presence.com are also strictly prohibited. Illegal activity such as hacking and cracking that originates from your account is also strictly prohibited. 2. Adult Content & Spamming We operate a zero tolerance policy on 'adult' content and spamming (the sending of mass unsolicited emails). Any 'adult' orientated material found in any account will result in instant termination without notice. Any unsolicited email sent over Dot Com Presence.com's network is strictly prohibited and may result in instant account termination without notice. This includes, but is not limited to, spam sent from networks outside of Dot Com Presence.com containing links to sites hosted by Dot Com Presence.com. Spam resource, email scraping software or any software that can be used as a spam tool may be deemed a Spam Resource at Dot Com Presence.com's sole discretion. We do not want spam, we do not want bulk mailers, if your site has a mailing list, you better make sure it's double opt-in (if you don't know what that is, ask us) or eventually, someone is going report you as a spammer and your account will be terminated regardless of the number of subscribers. So please be very careful in regards to this issue. 3. High Resource Usage Policy / Script Usage Resources are defined as CPU usage, memory usage and available system resources. When an account is found to be manipulating resources, we may implement the following policy: When an account is found to be manipulating resources, Dot Com Presence.com reserves the right to suspend, terminate, or make appropriate changes to the account to prevent the account from continually manipulating resources. This policy is only used in extreme cases to prevent misuse and is in effect to keep our servers fast and stable at all times. The following scripts and programs are BANNED from our servers due to resource manipulation / server misuse:
1. IRC (Internet Relay Chat) scripts or bots 4. Phishing Sites Any site found to be capturing or "pretending" to be another site for whatever reason, including but not limited to: Attempting to obtain personal information, such as credit card numbers, SSN (social security numbers). Will immediately be terminated, the site content will not be made available to you and the appropriate authorities will be contacted. 5. Any violations of these or other activities that Dot Com Presence.com deems abusive to Dot Com Presence.com's network or servers may result in immediate termination and cancellation of the offending account. 6. Payment Policies All accounts are set-up on a pre-pay basis. You will be automatically charged UNLESS a cancellation request has been sent to Dot Com Presence.com, and Dot Com Presence.com have confirmed your request. Cancellation requests must be sent in 5 days before your next billing date. In situations where the card number is declined, your account will be suspended automatically until you pay for the hosting account. If you fail to pay the bills for more than 7 days, your account may be permanently removed from our system unless other payment arrangements have been made. Since we use PayPal as our payment processor, you have the option of unsubscribing your recurring bill from the PayPal site. If you do, we will be notified by PayPal and we will assume that you intend to discontinue our service and we will terminate your account immediately. If you unsubscribe via PayPal for any other reason, such as changing credit card info at PayPal, please notify us first so we will not terminate your account. You agree that you are liable to extra charges that your account incurs, including but not limited to extra bandwidth usage and extra disk space usage. Cancellation requests logged within 30 days of the account being set-up will have their full monies refunded. 7. Cancellation and Refunds Dot Com Presence.com reserves the right to terminate an account at anytime without prior notification if the account is in breach of the listed terms and conditions. No refund is given in such a situation. You can choose to cancel your account at any time. If within the first 30 days following the initial order, a full refund will be issued. This is referred to as our 30 day money back guarantee. Please allow 5 business days for a refund to be processed; please put in cancellation requests at least 5 days prior to your next billing date. CANCELLATIONS OUT OF THE 30 DAY PERIOD WILL NOT RECEIVE A REFUND. YOU HEREBY AGREE THAT DOT COM PRESENCE.COM IS NOT LIABLE TO ISSUE REFUNDS AFTER THE FIRST 30 DAYS. 8. Indemnification You agree to use all Dot Com Presence.com services and facilities at your own risk and agree to defend, indemnify, save and hold Dot Com Presence.com harmless from any and all demands, liabilities, losses, costs and claims including but not limited to attorney's fees asserted against Dot Com Presence.com, it's agents, officers and employees, that may arise directly or indirectly from any service provided by ourselves. You agree that this indemnification extends to all aspects of your account. You agree that you take ALL legal responsibility for your account use and that you supply current and truthful details when signing up and to keep these details currant.
